Job Description


The Licensing, Marketing and Intellectual Property Paralegal is responsible for legal activities regarding licensure for the Company's various business entities and sales and marketing purposes. The Paralegal is responsible for developing systems and processes to coordinate and show compliance during regulatory audits, exams and annual reports. They review marketing materials to ensure content complies with regulations and laws specific to that area of marketing, advising members of the Company's marketing department on appropriate disclosures, writing details of participation for different contests and sweepstakes offered by various departments within the Company, and registering the contests with the appropriate regulatory agencies as needed
The Paralegal will track, maintain and apply for on behalf of the Company the appropriate licensing in each state where licensing is required based upon the Company's different entities and various purposes of those entities, follow up with state regulatory agencies on status of applications/renewals, manage and maintain the licensing matter management system, and work with associates in different departments to obtain the required information for obtaining initial licenses and renewals.
The Paralegal will create, maintain, and manage databases, templates, and on-line and related systems for tracking licensing, training, trademarks and copyright, contract databases, and other specific functions. They will perform legal and related research using the internet and other resources tasks to ensure that the Company's intellectual property is protected.


• Keeps current licensing up to date, in place and applies for additional licensing when needed.
• Responds to requests for annual licensing examinations and audits by regulatory agencies.
• Performs the initial search on each new proposed mark prior to sending it out to outside counsel for registration and works with outside counsel through the registration as well as renewal processes.
• Maintains the licensing database/matter management system.
• Collaborates with various departments to obtain information needed for submittal to regulatory agencies to either apply for new licensing or obtain renewal of existing licenses.
• Follows up with state and other regulatory agencies regarding the status of license applications and renewals.
• Performs legal research when opening sales offices in new states to determine what licensing will be required. Conducts initial search of potential trademarks, advising clients of results and working with outside counsel during registration process.
• Performs Internet-based searches to ensure protection of the Company's intellectual property from infringement and unauthorized use by different outside third parties.
• Creates and delivers cease and desist letters to various third parties suspected of using and possibly infringing upon the company's intellectual property, as needed.
• Performs initial review of proposed marketing pieces submitted to the legal department for comments and approval.
• Advises the legal department's attorneys of potential problems from a business or regulatory standpoint related to licensing for company programs and business initiatives.
• Drafts Details of Participation for different Company marketing contests and sweepstakes.
• Submission of applications and supporting materials related to approval of contests and sweepstakes to regulatory agencies as needed.
• Serves as the liaison between the marketing department and assistant corporate counsel.

Job Requirements

• Bachelor's Degree in Paralegal Studies preferred; Associate’s Degree will be considered with equivalent experience.
• 5 or more years corporate marketing and licensing paralegal experience within a law firm or corporate legal department.
• Federal, state, and local laws and regulations involving regulatory licensing, sales and marketing matters, and intellectual property such as trademark and propriety matters.
• Preparation/assembly/proofreading of legal documentation including licensing applications and similar regulatory matters, Quality service fundamentals, MS Office Suite.
• Detail-oriented with strong analytical and problem solving skills, strong ability to think strategically and analyze information timely and accurately, strong interpersonal communication skills to deal effectively with all levels of the organization
